NOTICE OF SUCCESSOR TRUSTEE’S SALE
WHEREAS, Bobby Shannon Jones, a single person, and Andrea Reynolds, a single person, by a certain deed of trust dated December 17, 2013, and recorded on the 26th day of December 26, 2013, in Book 542, at Page 62, of the Deed Records of Ripley County, Missouri, did convey to Devin Kirby, as Trustee, the following described real estate, lying, situate and being in the County of Ripley, State of Missouri, to‑wit:
A part of the South Half of the Southeast Quarter (S ½ SE ¼) of Section 25, Township 24 North, Range 2 East of the Fifth Principal Meridian, Ripley County, Missouri and being further described as follows: Beginning at a point that lies South 89 degrees 35 minutes 00 seconds West 456.10 feet and North 12 degrees 48 minutes 00 seconds West 444.00 feet and North 88 degrees 38 minutes West 622.60 feet from the Southeast (SE) corner of the said Section 25 and run thence North 88 degrees 38 minutes 00 seconds West 295.00 feet; thence North 06 degrees 48 minutes 29 seconds West 428.44 feet; thence North 87 degrees 23 minutes 00 seconds East 295.00 feet; thence South 06 degrees 31 minutes 34 seconds East 448.84 feet to the point of beginning.
Subject to an easement for a private road along the North 15 feet of the above described property.
Also conveying hereby is a non-exclusive easement for ingress and egress along the following described strip of land: A part of the South half of the Southeast Quarter (S ½ SE ¼) of Section 25, Township 24 North, Range 2 East of the Fifth Principal Meridian, Ripley County, Missouri and being further described as follows: Beginning at a point that lies South 89 degrees 35 minutes 00 seconds West 456.10 feet and North 12 degrees 48 minutes 00 seconds West 942.90 feet from the Southeast (SE) corner of the said Section 25, and said point of beginning being on the Westerly right of way line of Missouri and being further described as follows: A 15.00 feet wide strip of land each side and parallel to the following described centerline: beginning at a Missouri State Highway 21 and run thence South 87 degrees 23 minutes 00 seconds West 1008.60 feet and there terminating. which conveyance was made in trust to secure the payment of one promissory note of even date with said deed of trust and therein particularly described, and,
WHEREAS, the said Devin Kirby has refused to act as Trustee herein and the holder of the note has appointed Bobbie Elliott as Successor Trustee pursuant to the terms of said Deed of Trust;
AND WHEREAS, default was made in the payment of said promissory note in accordance with the true tenor thereof;
NOW, THEREFORE, at the request of the legal holder of said note and deed of trust, and in pursuance of the terms and provisions thereof, notice is hereby given that I, Bobbie Elliott, as Successor Trustee, under the terms of said deed of trust, will on Friday, June 12, 2020, between the hours of nine o’clock in the forenoon and five o’clock in the afternoon of that date, more specifically at 1:00 p.m., at the East door of the courthouse in the City of Doniphan, Ripley County, Missouri, expose said real estate for sale at public venue to the highest bidder for cash in hand to satisfy said debt and the expense of executing this trust.
Pursuant to the Fair Debt Collection Practices Act, 15 U.S.C. Sec. 1692c(b), no information concerning the collection of this debt may be given without the prior consent of the consumer given directly to the debt collector or the express permission of a court of competent jurisdiction. The debt collector is attempting to collect a debt and any information obtained will be used for that purpose.
