NOTICE OF SUCCESSOR TRUSTEE’S SALE

WHEREAS, MARK ELLIOTT, an umnanied person, by a certain Deed of Trust dated April 4, 2014 and recorded on Apri14, 2014, in Book 545 at Page 80, of the Deed Records of Ripley County, Missouri, did convey to Devin Kirby, as Trustee for BANK OF GRANDIN, A Missouri Corporation of the County of Ripley, State of Missouri, the following described real estate, lying, situate and being in the County of Ripley, State of Missouri, to-wit:

Tract 1: All that part of the North half of the southwest Quarter of Section 5, Township 23 North, Range 3 East, described as follows: Beginning at the Northwest corner of the North half of the Southwest Quarter of said Section, Township and Range; thence run South 396 feet; thence run East 660 feet; thence run North 396 feet; thence run West 660 feet to the point of beginning. EXCEPT a one half interest in all oil, minerals and underground valuables heretofore reserved.

Tract 2: All that part of the North half of the Southwest Quarter of Section 5, Township 23 North, Range 3 East, described as follows: Commencing at the Northwest corner of the North half of the Southwest Quarter of said Section, Township and Range; thence run South 594 feet for a point of beginning; thence run East 660 feet; thence run North 198 feet to the Southeast corner of property described at Book 484 Page 200; thence run West 660 feet to the Southwest corner of said Book and Page; run thence South 198 feet more or less to the point of beginning. EXCEPT a one half interest in all oil, minerals and underground valuables heretofore to reserved. (Description Supplied)

which conveyance was made in trust to secure the payment of one promissory note of even date with said Deed ofrrust and therein particularly described, and,

WHEREAS, the said Devin Kirby has refused to act as Trustee herein and the holder of the

note has appointed Marilyn Hart as Successor Trustee pursuant to the terms of said Deed of Trust;

AND WHEREAS, Default was made in the payment of said promissory note in accordance

with the true tenor thereof;

NOW, THEREFORE, at the request of the legal holders of said note and deed of trust, and in pursuance of the tenns and provisions thereof, notice is hereby given that I, Marilyn Hart, as Successor Trustee, under the terms of said deed of trust, will on May 28, 2020, between the hours

of nine o’clock in the forenoon and five o’clock in the afternoon of that date, to-wit 9:15 a.m. at the front door of the courthouse in the City of Doniphan, Missouri, Ripley County, expose said

real estate for sale at public venue to the highest bidder for cash in hand to satisfy said debt and

the expense of executing this trust.

NOTICE

Pursuant to the Fair Debt Collection Practices Act, 15 U.S.C. Sec. 1692c(b), no information concerning the collection of this debt may be given without the prior consent of the consumer given directly to the debt collector or the express permission of a court of competent jurisdiction.

The debt collector is attempting to collect a debt and any information obtained will be used for

that purpose.
