NOTICE OF SUCCESSOR TRUSTEE’S SALE

WHEREAS, R. Eugen Fox a/k/a Roy Eugene Fox a/k/a Roy Eugene Fox, Jr., an unmarried person, did by certain a Deed of Trust and Note dated December 14, 2018; recorded on December 19, 2018, in Book 603 at Page 124 in the Recorder’s Office in Ripley County, Missouri; did convey to Devin Kirby as trustee of the following described real estate, lying, situate and being in the County of Ripley, State of Missouri, to-wit:

All of the East Half of the Northwest Quarter of the Northeast Quarter; and all of the West Half of the Northeast Quarter of the Northeast Quarter, Except the following described tract: A tract 35 yards East and West and 140 yards North and South, in the Northeast corner of said West Half of the Northeast Quarter of the Northeast Quarter, all in Section 11, Township 23 North, Range 3 East of the Fifth Principal Meridian, Ripley County, Missouri.

which conveyance was made in trust to secure the payment of one promissory note of even date with said Deed of Trust and therein particularly described, and,

WHEREAS, the said Devin Kirby has refused to act as Trustee herein and the holder of the note has appointed Lindsay Turner as Successor Trustee pursuant to the terms of said Deed of Trust;

AND WHEREAS, Default was made in the payment of said promissory note in accordance with the true tenor thereof;

NOW, THEREFORE, at the request of the legal holders of said note and Deed of Trust, and in pursuance of the terms and provisions thereof, notice is hereby given that I, Lindsay Turner, as Successor Trustee, under the terms of said deed of trust, will on May 28, 2020, between the hours of nine o’clock in the forenoon and five o’clock in the afternoon of that date, to-wit 9:00 a.m. at the front door of the courthouse in the City of Doniphan, Missouri, Ripley County, expose said real estate for sale at public venue to the highest bidder for cash in hand to satisfy said debt and the expense of executing this trust.
