NOTICE OF SUCCESSOR TRUSTEE’S SALE

WHEREAS, CODY WILSON SHIPMAN and KAITLYN RENEE SHIPMAN, husband and wife, by a certain deed of trust dated July 23, 2019, and recorded on the 26th day of July, 2019, in Book 611, at Page 46, of the Deed Records of Ripley County, Missouri, did convey to Devin Kirby, as Trustee, the following described real estate, lying, situate and being in the County of Ripley, State of Missouri, to‑wit:

TRACT #1:

All that part of the Northwest Quarter of the Northeast Quarter of Section 23, Township 23 North, Range 3 East, lying South of the Old Doniphan and Poplar Bluff Road (Center Hill Baptist Church Road) described as follows: Commencing at a point where the South right of way of the Old Doniphan-Poplar Bluff Road (known as the Center Hill Baptist Church Road) intersects the West line of the Northwest Quarter of the Northeast Quarter and run Northeasterly along and with the South right of way of said Road 350 feet to the Northeast corner of a tract described at Book 236 Page 6 of the deed records of Ripley County, Missouri, for a point of beginning of the land herein conveyed; run thence South 603 feet, more or less to the South line of said Northwest Quarter of the Northeast Quarter, run thence East 375 feet; run thence North 293 feet; run thence West 167 feet; run thence North 310, more or less, to the South right of way of the Old Doniphan-Poplar Bluff Road; run thence Southwesterly along and with the South right of way of said road 208 feet, more or less, to the point of beginning.

All that part of the Northwest Quarter of the Northeast Quarter of Section 23, Township 23 North, Range 3 East lying South of the Old Doniphan and Poplar Bluff Road (Center Hill Baptist Church Road) described as follows: Commencing at a point where the South right of way of the Old Doniphan-Poplar Bluff Road (known as the Center Hill Baptist Church Road) intersects the West line of the Northwest Quarter of the Northeast Quarter and run Northeasterly along and with the South right of way of said Road 558 feet to the Northeast corner of a tract described at Book 343 Page 171 of the deed records of Ripley County, Missouri, for a point of beginning of the land herein conveyed; run thence South 310 feet, more or less along the East line of the tract described at Book 343, Page 271; run thence East 167 feet along and with the boundary of said tract described at Book 343, Page 271; run thence North 310, more or less, to the South right of way of the Old Doniphan-Poplar Bluff Road; run thence Southwesterly along and with the South right of way of said road to the point of beginning.

All that part of the Northwest Quarter of the Northeast Quarter of Section 23, Township 23 North, Range 3 East, lying South of the Old Doniphan and Poplar Bluff Road (Center Hill Baptist Church Road) described as follows: Commencing at a point where the South right of way of the Old Doniphan-Poplar Bluff Road (known as the Center Hill Baptist Church Road) intersects the West line of the Northwest Quarter of the Northeast Quarter and run Northeasterly along and with the South right of way of said Road 350 feet to the Northeast corner of a tract described at Book 236 Page 6 of the deed records of Ripley County, Missouri; run thence South 603 feet, more or less to the South line of said Northwest Quarter of the Northeast Quarter; run thence East 375 feet to a point of beginning of the land herein conveyed; continue thence East 220 feet; run thence North 430 feet; run thence West 220 feet; run thence South 430 feet, more or less, to the point of beginning.

All that part of the Northwest Quarter of the Northeast Quarter of Section 23, Township 23 North, Range 3 East, lying South of the old Doniphan and Poplar Bluff Road (Center Hill Baptist Church Road) described as follows: Commencing at a point where the South right of way of the old Doniphan and Poplar Bluff Road (known as the Center Hill Baptist Church Road) intersects the West line of the Northwest Quarter of the Northeast Quarter and run Northeasterly along and with the South right of way of said road 350 feet to the Northeast corner of a tract described at Book 236, Page 6 of the deed records of Ripley County, Missouri; run thence South 603 feet, more or less, to the South line of said Northwest Quarter of the Northeast Quarter; thence run East 595 feet; run thence North 430 feet to the point of beginning; run thence West 220 feet; run thence North 91 feet; run thence East 297 feet; run thence in a Southwesterly direction to the point of beginning.

All that part of the Northwest Quarter of the Northeast Quarter of Section 23, Township 23 North, Range 3 East, lying South of the Old Doniphan and Poplar Bluff Road (also known as the Center Hill Baptist Church Road) described as follows: Commencing at a point where the South right of way of the old Doniphan and Poplar Bluff Road (known as the Center Hill Baptist Church Road) intersects the West line of the Northwest Quarter of the Northeast Quarter and run Northeasterly along and with the South right of way of said Road 350 feet, more or less, to the Northeast corner of a tract of land described in Book 236, Page 6 of the deed records of Ripley County, Missouri; thence run South along the East line of the above mentioned tract to the South line of said Northwest Quarter of the Northeast Quarter to the point of beginning, thence run West 220 feet; thence run North 200 feet; thence run East 220 feet, more or less, to the East line of the tract of land described in Book 236, Page 6 of the deed records in Ripley County, Missouri, thence run South 200 feet, more or less, to the point of beginning.

TRACT #6:

All that part of the Northwest Quarter of the Northeast Quarter of Section 23, Township 23 North, Range 3 East, lying South of the old Doniphan and Poplar Bluff Road (also known as the Center Hill Baptist Church Road) described as follows: Commencing at a point where the South right of way of the old Doniphan and Poplar Bluff Road (known as the Center Hill Baptist Church Road) intersects the West line of the Northwest Quarter of the Northeast Quarter and run Northeasterly along and with the South right of way of said road, 350 feet to the Northeast corner of a tract of land described in Book 236, Page 6 of the deed records Ripley County, Missouri; run thence South 603 feet, more or less, to the South line of said Northwest Quarter of the Northeast Quarter; thence run East 375 feet; run thence North 521 feet, more or less, to the Northwest corner of a tract of land described in Book 356, Page 52 of the deed records of Ripley County, Missouri and the point of beginning of the land herein described; thence run East 297 feet; thence run North to the South right of way of the old Doniphan and Poplar Bluff Road (known as the Center Hill Church Road) thence run in a Southwesterly direction to a point due North to the point of beginning; thence run South to the point of beginning.

which conveyance was made in trust to secure the payment of one promissory note of even date with said deed of trust and therein particularly described, and,

WHEREAS, the said Devin Kirby has refused to act as Trustee herein and the holder of the note has appointed Bobbie Elliott as Successor Trustee pursuant to the terms of said Deed of Trust;

AND WHEREAS, default was made in the payment of said promissory note in accordance with the true tenor thereof;

NOW, THEREFORE, at the request of the legal holder of said note and deed of trust, and in pursuance of the terms and provisions thereof, notice is hereby given that I, Bobbie Elliott, as Successor Trustee, under the terms of said deed of trust, will on Friday, October 9, 2020, between the hours of nine o’clock in the forenoon and five o’clock in the afternoon of that date, more specifically at 1:00 p.m., at the East door of the courthouse in the City of Doniphan, Ripley County, Missouri, expose said real estate for sale at public venue to the highest bidder for cash in hand to satisfy said debt and the expense of executing this trust.

Sec. 1692c(b), no information concerning the collection of this debt may be given without the prior consent of the consumer given directly to the debt collector or the express permission of a court of competent jurisdiction. The debt collector is attempting to collect a debt and any information obtained will be used for that purpose.
